Thousands of homeowners along Spain’s coastline could have their properties demolished by the state as the controversial Ley de Costas (Coast Law) is enforced nationwide.
The law, passed in 1998, forbids the construction of any privately owned property within 100 metres of the sea, as beaches are now considered nationalised public property. This could hit buyers who have purchased beachside homes. There are an estimated 20,000 such properties in Marbella alone.
However, buyers who are affected may be entitled to compensation. One British couple, Len and Helen Prior, who lost their Almeria home after it was destroyed by the government, have now won a court case in the Spanish Supreme Court. The court found that the demolition of their property in Spain was illegal as correct procedures to seek planning permission initially had not been followed. The couple has claimed £570,000 in damages from Vera Town Hall, although they have yet to receive payment.
