A New York court has ruled that it is lawful for the state to seize private land for use by private developers wishing to build property in New York, among a range of other facilities, if it is considered to be in the “public good”, reports the Wall Street Journal.
The judgement was made yesterday after the state had seized property for the proposed Atlantic Yards development in Brooklyn, which will now be able to go ahead. The project, being developed by Forest City Ratner could eventually include office towers, new apartments, as well as an arena for the NBA's New Jersey Nets.
The decision has been criticised by New York property owners in the area who have argued that there is nothing that they can do to oppose the government once it deems their land necessary for eminent domain, or the "public good."
